1. Acceptance of Terms

By accessing or using RETSY Connect, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Description of Service

RETSY Connect provides real estate workflow tools including listing QR code generation, lead capture, contact sharing, analytics, messaging, and collaboration features.

3. Eligibility

You must be at least 18 years old to use RETSY Connect. If registering on behalf of a company or brokerage, you represent that you have authority to bind that entity.

4. Account Registration & Security

You agree to provide accurate account information, maintain credential confidentiality, and notify us promptly of unauthorized account use.

5. Acceptable Use

You may not use RETSY Connect to:

• Violate applicable laws.
• Scrape, reverse engineer, or disrupt service security.
• Spam contacts collected via the platform.
• Upload infringing content.
• Harass, threaten, or abuse other users.

6. User Content & License

You retain ownership of content you upload. You grant RETSY Connect a non-exclusive, worldwide license to host, process, and display that content as needed to operate and improve the service.

7. Third-Party Services

RETSY Connect integrates with third-party services including Google, Apple, and Firebase. Your use of those services is subject to their terms and policies.

8. Fees & Subscriptions

9. Intellectual Property

RETSY Connect, including the name, logo, and software, is owned by RETSY, LLC and protected by intellectual property laws.

10. Termination

We may suspend or terminate accounts for violations of these Terms. You may stop using the service and close your account at any time.

11. Disclaimers

RETSY Connect is provided “AS IS” and “AS AVAILABLE” without warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the maximum extent permitted under Arizona law, our aggregate liability is limited to the greater of {$100} or fees paid in the prior 12 months.

13. Indemnification

You agree to indemnify and hold harmless RETSY Connect and its affiliates from claims or losses arising out of your breach of these Terms or misuse of the service.

14. Dispute Resolution & Arbitration

Before filing formal claims, the parties agree to attempt informal dispute resolution. If a dispute remains unresolved, it will be resolved through binding arbitration in Maricopa County, Arizona under AAA rules, with a class action waiver. You may opt out of arbitration within 30 days of first accepting these Terms by sending notice to info@RETSY.com.

Attorney review required: arbitration language should be reviewed by Arizona counsel.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Exclusive venue for any non-arbitrable disputes is the state or federal courts located in Maricopa County, Arizona.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the service after updates are posted constitutes acceptance of the revised Terms.

17. Miscellaneous

These Terms are the entire agreement between the parties. If a term is unenforceable, the remaining terms remain effective. Failure to enforce a right is not a waiver. We may assign these Terms in connection with a merger, acquisition, or asset sale.
